# Terms of Service

The Terms of Service govern the conditions for obtaining the Services, payment, and use of the Bot software.

Please carefully read the Terms of Service to familiarize yourself with the algorithm for using the Bot's functions.

References to the words "you" or "your" (or words of similar meaning) mean our User or Data Subject, depending on the context of the Privacy Policy.

References to the words "we", "our" or "us" (or similar words) mean Themis Bot.

The words he/she and their derivatives in the text of the document can refer to either a male or a female person depending on the context of the document.

Use the functions of the Bot and set up the security of receiving email messages.

1. **DEFINITIONS**

1.1 **User** - is an individual using the Bot Services using the Discord platform and receives the Services from the Company.

1.2 **Data Subject** - is a natural person or software (identifying itself as a natural person) that interacts with Discord Guild (server) and whose actions are recognised as rule violation and blocked by Bot.

1.3 **User's Consent (hereinafter "Consent")** - means a voluntary, specific, informed, and unequivocal expression of will, in which the User using a statement or explicit affirmative action agrees to the conditions of use of the Bot.

1.4 **Personal Data** - means any information that directly or indirectly allows identifying the User. For example, name, surname, phone number, contact phone.

1.5 **Themis Bot (hereinafter "Themis" or "Bot")** - is an advanced security Discord bot that can be configured to prevent different kinds of attacks on Discord  Guild (server).&#x20;

1.6 **Themis website (hereinafter "Site")** - means a web page or a group of web pages on the Internet, which are located at  [https://themisbot.com/](https://alwond.com/) , through which the User receives the Services.

1.7 **Company** - is a LTD Alwond Limited, registered under the laws of Hong Kong, registration number: 74169119-000-06-22-2, legal address: Room 1308, Multifield Plaza, 13/F, 3 Prat Ave, Tsim Sha Tsui, Hong Kong, which owns all property and intellectual rights to the Bot software and content.

1.8 **Third Party** - means a natural or legal person, government agency, institution, or body other than the User, Data Subject or Bot.

1.9 **Services** - providing the User with access to the functions of the Bot, in order to protect his Guild (server) from raids, evil, and spam that could harm his Guild (server).

1.10 **Discord Guild (hereinafter referred to as the "Guild")** - is a server on the Discord platform that unites a group of people with specific interests, providing members with the opportunity to create channels, member rolls, etc.

1.11 **Administrator** - is an individual who is assigned a role in a Guild on the Discord platform and has special permission to perform certain activities and/or functions in that Guild that are not available to other Users of that Guild.

1.12 **Server Owner** - is an individual who creates a Guild on the Discord platform, is its owner and can manage the Guild, including its removal.

2. **GENERAL PROVISIONS**

2.1 Registration on the Site is not required to access the functions of the Bot, and access to the Bot is provided using your profile of the Discord platform.

2.2 Company employees manually sort and check domains that may contain security risks for the User, and the software automatically blocks the Data Subject.

2.3 For all Users, a basic version of the Bot is available, which is in the public domain and free of charge. Also, Users have the right to try the premium version of the Bot on a free basis by voting for the Bot on the top.gg website.

2.4 To gain access to the basic mode of the Bot: The user must perform the following actions:

&#x20;      2.4.1 create your own Guild;\
&#x20;      2.4.2 add the Bot to the Guild;\
&#x20;      2.4.3 use the functionality of the Bot.

3. **SERVICE PROVISION**

3.1 The Bot provides its Services to Guilds hosted on the Discord platform, but does not provide its Services to other platforms, websites or web portals.

3.2 The Bot provides the User with the following functions:

&#x20;      3.2.1 **Anti-Webhook.** When the Bot sees the created webhook, but the Data Subject who created it is not included in the white list, the list with permissions, then the Bot deletes this webhook.\
&#x20;      3.2.2 **Anti-Spam.** Automod function that can block users who violate one of the filters:

&#x20;                3.2.2.1 Blocks repeated messages - Repeated Messages;\
&#x20;                3.2.2.2 Blocks links to other sites - External Links;\
&#x20;                3.2.2.3 Blocks invites to other servers - Server Invites;\
&#x20;                3.2.2.4 Blocks Zalgo texts - Zalgo.

The Bot function allows the Administrator or Server Owner to impose a penalty in case of violation:

* Kick - remove a person from the Guild with the ability to log in again
* Ban - remove a person from the Guild without the possibility of re-entering the Guild.

&#x20;     3.2.3 **Verification.** Additional verification of incoming Data Subjects using the captcha function. Verification is carried out as follows: when the Data Subject enters the Guilds, then only one channel is available for him, where he undergoes additional verification by entering numbers from the picture.

&#x20;     3.2.4 **Anti-Nuke (paid feature)**. Guild (server) protection system. How it works: The Bot has 5 factors/flags, which are signals that determine whether the Guild is compromised or not.

&#x20;     3.2.5 **Fake Detection (paid feature)**.Implementation of checking the names of the Subject of Data against prohibited ones, to identify potential violators and spammers. How it works: The Bot has 2 dictionaries: local and global. Each Guild has its local dictionary, where the Guild Administrator can add prohibited names (for example, the name Free Money) and at each iteration, the Bot will go through all Data Subjects and block violators.

&#x20;     3.2.6 **Anti-Raid (paid feature)**. This function is to check and block suspicious Data Subjects (bots). How it works: Bot uses an algorithm that runs automatically in the background to stop Data Subject bots from raiding the Guild by blocking such threats, through precise detection that avoids real Data Subjects.

3.3 Any blocking of a Data Subject by a Bot is not final and is reviewed by an employee of the Company, and the Administrator or Server Owner may cancel any blocking of the Data Subject.

3.4 Bot functions are configured by the Administrator or Server Owner, according to their rights in the Guild. A normal User cannot configure the Bot's functions, and the Bot performs a role check for each User that changes the settings' functions. If the role of the User does not correspond to the role of Administrator or Server Owner, then such User will not be able to change the functions of the Bot.

3.5 The powers of the Administrator or the Server Owner are regulated in more detail by the documentation of the Discord platform, which you can find in the corresponding section of the Discord website.

4. **PAYMENT PROCEDURE**

4.1 The Bot provides both free and paid access to its functions. At the moment, there are no specific tariffs for paying the cost, but they can be provided and indicated in a certain section of the Site.

4.2 The cost of access to the paid functions of the Bot is indicated in the relevant section of the Site and can be changed by the Bot unilaterally. In the event of a change in the cost of access to the functions of the Bot, the Company may notify the User by posting this information in the appropriate section of the Site or by email.

4.3 The Bot сompany may provide tariffs (packages) for gaining access to the Bot functions, which are indicated in the relevant section of the Site.

4.5 The user pays for access to the Bot's paid functions in the form of a subscription, which is charged automatically by the Company.

4.6 The methods and forms of payment are indicated in the appropriate section of the Site, and the Company provides various types of payments, including cryptocurrency.

5. **REFUNDS**

5.1 Payment for the Services is in the form of a subscription, so the purchase of the Services is final and non-refundable.

5.2 The Bot сompany has the right to make a refund, but the refund is made only within 7 (seven) calendar days after the first payment has been made and the Bot сompany can refund the first payment. After the expiration of 7 (seven) calendar days after the first payment is made, the Bot сompany does not return the money.

5.3 To return the funds, the User undertakes to send a request to the Bot сompany to the email address: <hello@alwond.com> and/or to the official Discord server:<https://discord.gg/themisbot> and/or to the social network Twitter account:<https://twitter.com/ThemisBot> Such a request must contain the following information: confirmation of the User's identity and description of the User's order. If we are unable to verify your identity or receive a description of the reasons for the refund or are unable to verify possession of your bank details (bank card), then we will not be able to process the refund.

5.4 In the event of a refund, the Bot сompany returns the funds within 7 (seven) calendar days from the date of receipt of the request for a refund to the bank details specified by the User when paying for the Services in the subscription form.

5.5 The User has the right to refuse to receive the Service and cancel the subscription to such Services at any time. To cancel a subscription, the User needs to write to the following e-mail address: <hello@alwond.com> and/or to the official Discord server:<https://discord.gg/themisbot> and/or to the social network Twitter account:<https://twitter.com/ThemisBot> a request indicating the cancellation of the subscription and indicating your identity data. The Bot сompany has the right to request the User to confirm his Personal Data in the manner determined by the Bot сompany, and if the User cannot provide such confirmation, the Bot сompany has the right not to cancel the subscription to the Services. Your cancellation will take effect at the end of the current paid period. There are no refunds for our subscription Services.

6. **INTELLECTUAL RIGHTS**

6.1 All exclusive intellectual property rights to the content of the Bot and other objects, as well as components and their elements, belong exclusively to Company.

6.2 The Company grants the User a non-exclusive right to use the Services.

6.3 The User grants the Company the non-exclusive right to use, copy, process and transfer his Personal Data during the term of using the Services.

6.4 The User guarantees that the Personal Data and information provided by him do not infringe the intellectual property rights of a Third Party.

6.5 If the Personal Data and/or information provided by the User violates the intellectual property rights of a Third Party, the Company reserves the right to stop providing the Services.

7. **RESPONSIBILITY**

7.1 The User is solely responsible for providing reliable information, and Personal Data while using the Bot.

7.2 The User is solely responsible for the use of the functions of the Bot, and the Company is not liable for any damage to the User that arose as a result of the use of the functions of the Bot.

7.3 The User is solely responsible for the safety of any data necessary to access the platform Discord.

7.4 The content (information and personal data) published by the User in his Guild must not contain the following data:

1. in any way violates the rights of a Third Party, including property and/or intellectual rights;
2. contains illegal information;
3. contains false or incorrect information;
4. confuse;
5. contains signs of a pornographic or sexual nature, profanity;
6. humiliates the honor and dignity of a Third Party, other Data Subject;
7. incites interracial, interethnic, religious, sexual, and political hatred;
8. violates the rights and/or freedoms of Third Parties;
9. contains links to Third Party websites that may harm the Third Party's software;
10. contains an arbitrary set of characters that do not make sense;
11. contains links to sites that distribute pornography, unlicensed software, and/or media files or incite interracial, ethnic, religious, sexual, and political hatred;
12. contains links to information that is open advertising sites for network marketing, affiliate marketing, pyramid schemes, earnings at home, and other types of fraud;
13. contains obscene language;
14. contains flood;
15. contains different ways to attract potential customers like "get rich quick", "build your wealth", "financial independence", etc.;
16. in which the rules of grammar are not observed;
17. contains proposals for restructuring loans and releasing debts;
18. contains advertising of alcoholic and/or tobacco products;
19. contains spam;
20. contains incitement to violence;
21. contains slander against a Third Party;
22. written in capital letters only;
23. uses several grouped punctuation marks;
24. contains links to sites that are dating services, escorts, etc.;
25. contains links to websites and/or information about courses for personal growth, career development, etc.

7.5 The User undertakes not to carry out the following actions:

1. use the functions of the Bot unlawfully or illegally;
2. copy, adapt, decipher, decompile, disassemble, or reverse engineer any software that constitutes or is in any way part of the Bot or the Site;
3. use the Bot for the Guild, which contains signs of a destructive and/or terrorist organization, which in any way can conduct illegal or illegal activities;
4. use the Bot for the Guild, which will contain illegal content, in accordance with clause 7.4. stage of the Terms of Service;
5. use a Bot for a Guild that deceives its members in any way or contains signs of fraudulent activity.

7.6 Conditions of clauses 7.4. and 7.5. may not be exhaustive, and the Company reserves the right to apply the sanctions specified in these Terms of Service based on its sole discretion.

7.7 If the User violates these Terms of Service, the Company has the right to apply the following penalties to the User:

1. block or restrict the User's access to the Bot's functions;
2. cancel the User tariffs for access to the functions of the Bot;
3. cancel the User's access to paid functions of the Bot;
4. block the User's access to the Bot's functions both for a certain period and forever.
5. terminate the relationship with the User.

7.8 The Company does not monitor the violation by the User of the Rules of Use, including violations of clauses 7.4. and .7.5., but if we become aware of such a violation, we may apply penalties to such User. The Bot сompany takes a single decision on the application of sanctions to the User. In case of termination of relations with the User, including the complete blocking of access to the Bot's functions, the return of payments to the User paid for providing access to the Bot's functions is not carried out.

7.9 The Themis does not guarantee:

1. uninterrupted access to the Company's Site;
2. uninterrupted access to the Services;
3. uninterrupted access to Bot functions;
4. performance by the Bot of its functions;
5. control of the User Guild.

7.10 Themis reserves the right, but not the obligation:

1. monitor violations of these Terms of Service;
2. take appropriate legal action against anyone who, in its sole discretion, violates the law or these Terms of Service, including, without limitation, reporting such User to law enforcement;
3. in our sole discretion and without limitation, notice or liability, remove from the Site/Bot or otherwise disable all files and content that are excessive in size or otherwise burden our systems;
4. administer the Site/Bot in a manner that protects our rights and property and facilitates the proper functioning of the Site/Bot.

7.11 To the extent permitted by law, we provide the materials and Services on an "as is" basis. This means that we make no warranties of any kind, including but not limited to warranties of merchantability and fitness for a particular purpose.

7.12 **Themis WILL NOT BE LIABLE FOR EFFECTS CAUSED BY AN ACT HACKERS, CRIMINAL SOFTWARE CHANGES, AND OTHER TYPES OF UNAUTHORIZED ACCESS AND USE OF SITE.**

8. **GOVERNING LAW AND DISPUTE RESOLUTION**

8.1 All relationships between the Company and the User arising in connection with the fulfillment of the terms of these Services, about the use and use of the Services, shall be governed by the laws of the Hong Kong.

8.2 To expedite resolution and control the costs of any dispute, controversy, or claim related to these Terms of Service (each a “Dispute” and collectively “Disputes”) brought by you or us (individually a “Party” and collectively the “Parties »), the Parties agree to first attempt to arbitrate any Dispute (other than Disputes expressly set forth below) informally at least 10 (ten) business days before the commencement of the arbitration. Such informal negotiations begin after written notice from one Party to the other Party.

8.3 Any dispute arising out of or in connection with this agreement, including any question as to its existence, validity, or termination, shall be referred to and finally decided by the Hong Kong International Arbitration Center (“HKIAC”) in accordance with laws of Hong Kong. The number of arbitrators is one. The legal place of arbitration is the city of Hong Kong. The language of the proceedings is English.

8.4 The Parties agree that any arbitration will be limited to the dispute between the Parties individually. To the fullest extent permitted by law, (a) no arbitration shall be combined with any other proceeding; (b) has no right or authority to litigate any dispute on a class action basis or to use class action procedures; (c) has no right or authority for any dispute to be brought in a representative capacity on behalf of the general public or any other persons.

9. **USER CONSENT**

9.1 By signing these Terms of Service, the User agrees to:

1. write-off of funds automatically, in the form of a subscription, as payment for the receipt of the Services (access to the functions of the Bot);
2. conditions for obtaining access to the functions of the Bot;
3. the conditions for the refund of payments specified in Section 5 of these Terms of Service;
4. gaining access to the functions of the Bot, using the Discord platform;
5. with the conditions of these Terms of Service.

9.2 Themis reserves the right to obtain the consent of the User by using the marker in the appropriate section of the marker.

10. **IMPLEMENTATION OF CHANGES**

10.1 Themis has the right to amend these Terms of Service in the event of a change in the terms of the Services, access to the functions of the Bot, or changes in the cost of access to the functions of the Bot.

10.2 The User is obliged to familiarize himself with the new conditions of the Terms of Service, and Themis shall not be liable if the User has not read the new conditions of the Terms of Service.

10.3 Our electronic or otherwise stored copies of the Terms of Service shall be deemed to be the true, complete, current, and legally binding versions of these Terms of Service in effect at the time you visit the Site or access the features of the Bot. If the User uses the Services after the date the Terms of Service were updated, we may assume that the User has read the new version of the Terms of Service and agrees to the Services conditions.
